Terms and conditions

ACCEPTANCE OF OUR OFFERS AND OUR SUPPLIES IMPLIES ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE INDICATED BELOW.

PRICE

The prices indicated are inclusive of VAT (all taxes included) and excluding shipping costs (except promotion or specific indications).

Delivery in France and Corsica only:
For all orders under 150.00 euros (incl. VAT), a flat-rate delivery charge of 5.90 euros (incl. VAT) applies. Orders greater than or equal to 150.00 euros (incl. VAT) are shipped free of charge. Orders or items shipped free of charge (pouches) are indicated for delivery in mainland France and Corsica only. The prices indicated are valid only on the day your order is registered, and may be modified without prior notice.

DELIVERY TIMES AND CONDITIONS

We acknowledge receipt of your order by return email (mandatory field to answer you). Orders are managed in the order of their arrival and to the extent of the availability of products regularly offered for sale. Orders are shipped within 24/48 hours (working days) upon confirmation and validation of payment. Delivery times vary from 24 to 72 hours. The deadlines that we indicate are subject to delay resulting from cases of force majeure and beyond our control (strike, damage, etc.).

Packages are sent by post (collissimo followed) or by private carrier. In case of absence of the buyer at the time of delivery, the carrier notifies his passage by slip and informs of the terms of removal by the customer or his subsequent passage. If the carrier is unable to deliver the goods for reasons related to the customer (absence, incorrect address, insufficient information, etc.) and after two unsuccessful visits, LE MONDE DE LA VANILLE cannot be held responsible for the delay in delivery
In the event of temporary stock shortages, we will inform the customer, who may cancel the purchase at any time. In this case, we undertake to reimburse the customer for all sums paid.
Products are delivered to the address indicated by the customer at the time of ordering.

It is up to the customer to ensure the compatibility of this delivery method with the security of his mailbox (with restricted access).

The information provided by the carrier is authentic (flashing & tracking of the package).

In the event of disputes, our responsibility cannot be called into question. Our intervention is limited to putting the customer in touch with the customer service of the carrier. The seller’s liability ceases as soon as the consumer takes possession of the goods (package indicated ” delivered “), . The risks of loss or damage are transferred to the consumer.

In the event of the carrier’s refusal to pay compensation, we remind you of articles L133-3 & L.224-65 of the French Consumer Code at to turn against the service provider in charge of transporting the goods and the related responsibilities.

WITHDRAWAL – WARRANTY – RETURN OF GOODS – DOCUMENTATION.

Any claim to be admissible must be made within 48 hours of receipt of the goods (in writing).

It is the customer’s responsibility to report any anomalies (damaged package, damage, liquid leak, etc.) on the delivery note upon receipt of their package.

The customer will confirm the anomaly with the carrier within 48 hours, enclosing a copy of the declaration to MONDE DE LA VANILLE.

The buyer has a quality guarantee. We undertake to refund or exchange non-compliant products. Non-conformity is based on objective criteria: “mould, damage, abnormal odour such as creosote, pods that do not correspond to the description given at the time of sale”.
Opened packaging and used pods will not be reimbursed.
For any return of goods for which MONDE DE LA VANILLE is responsible, we will bear the cost of reshipment. For any other return, the costs of reshipping to our premises will remain the responsibility of the customer.

The refund of the order is sent to the buyer within two weeks after the return of the goods. Article L.121-20-2 of the French Consumer Code : the 7-day cooling-off period does not apply to the supply of foodstuffs.

the sending of documents related to an order is limited to the sole supply of the invoice & technical documents in our possession at the time of the order (technical data sheet, analysis bulletins if available).
The customer may not require AROM’ESSENCE – LMDV to send him information and/or quality questionnaires other than those related to our own documentation & brand.

DISPUTE – DISPUTE

Any dispute, whatever its nature or cause, shall be submitted exclusively to the jurisdiction of the Commercial Court of ” LE HAVRE “, even in the event of a warranty claim or multiple defendants.

” In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, AROM’ESSENCE SARL with the trade name “le monde de la vanille” brings to the attention of its customers:

Consumer mediation is subject to specific regulations, notably in the Consumer Code and in a European directive. Here are the main regulations in force:

Article L152-1 of the Consumer Code specifies that any consumer has the right to have free recourse to a consumer mediator with a view to the amicable resolution of the dispute between him and a professional. Professionals can set up their own mediation system, or propose recourse to a consumer mediator.
Articles R612-1 to R612-5 of the French Consumer Code set out how mediation works. In particular, the mediation system must be easily accessible, free of charge and the outcome of the mediation must occur within 90 days.
Article L221-5 of the Consumer Code provides, among other things, that the professional must communicate to the consumer information relating to the methods of settling disputes before the conclusion of a contract of sale or provision of services.
Article L221-3 of the Consumer Code provides that when concluding any written contract, the consumer is informed by the professional of the possibility of having recourse, in the event of a dispute, to the consumer mediation procedure.
Ordinance No. 2015-1033 of August 20, 2015 relating to the out-of-court settlement of consumer disputes, which transposes Directive 2013/11/EU which serves as a reference in terms of mediation legislation for all the States of the European Union. This ordinance is implemented by the implementing decree of October 30, 2015.

After prior written request from the consumer to AROM’ESSENCE SARL “le monde de la vanille”, ZA le clos des perdrix – côte des Chataigniers – 76700 gainneville, , the Mediation Service may be contacted for any consumer dispute for which AROM’ESSENCE – LMDV’s internal settlement has been unsuccessful. Payment is made as defined in the conditions provided for when ordering:

Online payment by credit card, your order will be dispatched as soon as payment is received.
Payment by cheque will no longer be possible after January 1st 2025.
